1. Introductory provisions

The purpose of this document is to specify the terms and conditions and the manner in which the Online Money Remittance Service is provided. This document and the T&C contain information pursuant to Section 132 of the AP for One-off Transactions and Section 133 et seq. of the AP for Regular Transactions, with which we as BESTPAY s.r.o., with registered seat at Purkyňova 74/2, Nové Město, 110 00 Prague 1, ID No.: 041 11 648, registered in the Commercial Register of the Municipal Court in Prague, file No. C 242665, ("BESTPAY") are obliged to inform you when providing services pursuant to the AP. We are a company licensed as a payment institution and subject to regulation by the Czech National Bank as a supervisory authority with its registered seat at Na Příkopě 28, 110 00 Prague 1. Upon request, we will provide you with information pursuant to Section 132 and Section 133 et seq. of the AP in paper. Unless otherwise stated, capitalized terms have the meaning defined in the T&C.

2. General provisions

We allow you to use the Online Money Remittance Service to enter Payment order for Transactions in the Application. The Online Money Remittance Service involves making a transfer of funds where neither the Customer nor the Payee uses a payment account with us (remittance). You are obliged to comply with the T&C and generally binding legislation when using the Online Money Remittance service.

3. Execution of Transactions

You can enter Payment orders in the Application. By confirming the Payment order in the Application you confirm the correctness of the entered information, and the Payment order is accepted. We will not execute a Transaction to or through a bank or financial institution listed as an entity, registered or providing services in or to a country supporting terrorism or high-risk countries. We will not execute a Transaction for the benefit of a Payee listed on the sanctioned entities list or if the Transaction meets the characteristics of a suspicious transaction.

Transactions within the Online Money Remittance Service are made only on the basis of:

  • properly completed and Authenticated Payment orders;
  • proper payment of the Transaction amount and all related fees;
  • proper and satisfactory performing your identification and control; and
  • verification of you, the Payee and your countries of origin/countries of Transaction against currently applicable sanction measures.

Elements of a Payment order:

Content of the Payment order

the account number of the Payee;

the amount and currency Transaction

the location of the cash pay-out for the Payee, if relevant

Information about the Payee

the full name of the Payee;

address of the Payee;

contact telephone number of the Payee;

We will refuse a Payment order and will not execute it if the conditions for its execution are not met or if binding legislation requires it. We will inform you of the refusal to execute a Payment order through the Application and to your registered email address. You may revoke a Payment order, but you may only do so until the Transaction is executed. In this case, there is no refund of the fee paid. Once you enter a Payment order to withdraw money in cash, you will receive an MTCN which you must provide to the Payee as part of the verification when collecting the Transaction amount.

4.Time limits for processing Payment orders

We accept Payment orders within the Application 24 hours a day / 7 days a week / 365 days a year. We process Payment orders within the following deadlines:

  • if you place a Payment order and the Transaction amount is credited to our account by 14:30 CET, the Payment order will be executed the same day;
  • if you place a Payment order and/or the Transaction amount is credited to our account after 14:30 CET, the Payment order will be executed on the next business day after receipt of the Payment order at the latest.

The above-mentioned time limits depend on the conditions of processing of the Transaction by the counterparty. The above-mentioned time limits do not apply to payment orders, where only the Payee or Payer is from an EU member state. If the Transaction amount is not collected by the Payee within 2 months, the funds will be refunded to you in the same manner in which the Transaction amount was paid, meaning if paid by payment card, the funds will be refunded to the payment card, if paid by a bank transfer, the funds will be refunded to the bank account. In this case, there is no refund of the fee.

5.Transaction Fee

We are entitled to charge you a fee for Transactions made. The amount of the fee is set out in the Price list. All fees must be paid by you with the payment of the Transaction amount or before the Transaction processing.

6. Exchange rates used for currency conversions

For the conversion of one currency into another currency (currency conversion for money transfers), we use the rate listed in the Application at the time of receipt of the Payment order.

7.Unauthorised and incorrectly executed Transaction

Unauthorised Transaction

You bear the loss from an unauthorised Transaction:

  • up to an amount equivalent to EUR 50 if the loss was caused by the use or misuse of a lost or stolen Device or ID, PIN or OTP;
  • in full if you have caused the loss by your fraudulent conduct or by your wilful or grossly negligent breach of any of your obligations under the T&C.

The EUR 50 limit for your liability in the event of loss, theft, or misuse of a Device or ID, PIN or OTP does not apply unless you have acted fraudulently and:

  • the loss, theft or misuse of a Device or ID, PIN and OTP could not have been detected by you prior to the unauthorised Transaction; or
  • the loss, theft or misuse of a Device or ID, PIN or OTP has been caused by our actions.

You do not bear any loss from an unauthorised Transaction at all, unless you have acted fraudulently and:

  • the loss occurred after you notified us of the loss, theft, or misuse of a Device or ID, PIN or OTP.;
  • We have not ensured that appropriate means are available to you to report the loss, theft, misuse or unauthorised use of a Device or ID, PIN or OTP at any time; or
  • we have breached our obligation to require strong Customer authentication.

If the loss from an unauthorised Transaction is borne by us, we will refund the Transaction amount, fees paid to you without undue delay, but no later than the end of the next business day after we become aware of the unauthorised Transaction, or you notify us of the unauthorised Transaction. The time limit for rectifying an unauthorised Transaction will not begin to run while we have reason to believe that you have acted fraudulently if we notify the supervisory authority in writing, together with a statement of our reasons.

Incorrectly executed Transaction:

If you notify us that you do not insist on executing the incorrect Transaction, we will refund the amount of the Transaction and the fees. This will only apply in respect of the amount of the ncorrectly executed Transaction that was not made available to the Payee before you notified us that you do not insist on the Transaction being executed, provided that we provide evidence of such pay-out to you and, where applicable, to the Payee's service provider. If you do not notify us that you do not insist on the execution of the incorrect Transaction, we will promptly arrange for the amount of the incorrectly executed Transaction to be provided to the Payee and we will refund to you the incorrect fees paid. If you have provided incorrect identification of the Payee, we will consider this is a correctly executed Transaction on our part, however, we will make every effort to refund the Transaction amount from this Transaction to you in the same manner in which the Transaction amount was paid.

You may exercise your right to rectify an unauthorised or incorrectly executed Transaction in a court of law or other competent authority if you notify us of the unauthorised or incorrectly executed Transaction without undue delay after you become aware of it, but no later than thirteen months from the date on which the amount of the Transaction was made available by you to execute the Transaction.

8. Complaints and grievances handling policy

Complaints and grievances are handled in accordance with the Complaints policy and the T&C, which are available at bpay.cz and generally binding legislation. You may refer any disputes that arise between us and you to a financial arbitrator. This authority for the resolution of disputes between providers and users of payment services operates in accordance with Act No. 229/2002 Sb., on the financial arbitrator, as amended. Financial arbitrator can be contacted at Legerova 39, Prague 1 – New Town,110 00. Your right to go to court or file a complaint with the Czech National Bank is not affected. 9. COMMUNICATION BETWEEN THE CUSTOMER AND BESTPAY

Communication between us and you is conducted primarily in Czech and English, or in other languages that may be available through our staff at the time. You can contact us: by phone, email, in writing, or in person at our registered seat. You can contact us through the following communication channels:

To improve the Online Money Remittance Service, we can monitor and record telephone calls. Documents and other written communications addressed to you are sent primarily through the Application or to your registered email address in accordance with the T&C. Documents and other written communications addressed to us should be sent primarily through the Application, to the above-stated email address, or to our registered seat, or to another agreed address. We comply with the rules for the provision of information and how it is provided through a durable medium arising from the AP by sending email messages to your registered email address. We will notify you of any suspected unauthorized or fraudulent use of your ID, PIN, OTP, or Device via email communication sent to your registered email address. Upon your request, you have the right to obtain from us the contents of the T&C and their annexes without undue delay after receipt of such request.
